About the Position

Associate Labour reporting to CEO/Director Labour Law Dept

PREFERRED MINIMUM EDUCATION

LLB undergraduate degree in law or relevant NQF 7 equivalent in law.
+  Must be an admitted attorney
+  Post graduate qualification with specialization in labour law will be an advantage

PREFERRED MINIMUM EXPERIENCE

+  Must have 2 to 4  years post article experience in a legal firm

COMPETENCIES
 
+  Advance computer literacy in respect of Microsoft and legal software programs
+  Own vehicle and valid driver's license
+  Clear criminal record and credit record

KEY PERFORMANCE AREAS

1.  Research and information compilation

1.1  Conduct thorough research for all department transactional matters
1.2  Review legislation and conduct research on all legal opinions for matters and prepare these for presentation to clients or directors, as may be applicable
1.3  Research, provide advice and furnish opinions for matters on legal strategies including the appropriate legal action to be taken
1.4  Continuously build on current legal skills and apply legal theory in a practical manner
1.5  Update job knowledge by participating in educational opportunities, reading professional publications, maintaining personal networks and participating in professional organisations
1.6  Prepare research papers for the Company newsletters
1.7  Ensure regulatory compliance with applicable legislation and parameters of SASLAW and/or other regulatory boards
1.8  Drafting, vetting and reviewing of client legal agreements inter alia contracts of employment, policies and procedures, disciplinary findings, collective bargaining agreements, termination agreements, etc
1.9 Chair and/or prosecute disciplinary/incapacity matters as and when required by clients
1.10  Facilitate collective bargaining inter alia wage negotiations, strikes, lock-outs and other related matters as and when required by clients

2.  Planning and preparation

2.1  Conduct mandatory administration of the Company, including file management and electronic timekeeping

2.2  Use the required legal technical skills to understand the client's requirements and deliver a service which is efficient and meets the client's expectations
2.3  Prepare legal material and consult with the clients to advise about their rights and legal procedures 
2.4   Draft, review and comment on agreements, as may be required by a director
2.5  Review all drafts submitted by any secretary, making amendments and checking for accuracy, prior to submission to a client or a director, as may be applicable
2.6  Upon approval of the director, prepare letters, correspondence emails or faxes and send these agreements and documents to clients
2.7  Attend hearings, conferences, interviews and trials, as may be applicable
2.8  Conduct or assist with due diligence investigations, as may be applicable
2.9  Assist in the preparation and submission of tenders, where required
2.10  Draft and prepare legal documentation inter alia objections, applications, requests, head of arguments, opening addresses, and other related pleadings
2.11  Timeously submit legal documentation to relevant courts and/or CCMA /Collective Bargaining Councils
2.12  Professional representation at CCMA/Collective Bargaining Council/Labour Court/Labour Appeal Court
2.13  Ensure that relevant witnesses are prepared /subpoenaed
2.14  Liaise with external counsel on the preparation of labour court matters and take responsibility for all external counsel and facilitation of such

3.  Negotiation
3.1  Negotiation matters of mutual interest on behalf of the client and/or consult with organized labour on matters as may be required

4.  Finance and Budget
4.1  Work according to a standard fee structure and reach the required billing targets monthly
4.2  Monitor and report billings to clients as milestones are reached and become involved in collection of outstanding amounts due and payable by clients

5.  Administration
5.1  Handle matters of moderate complexity, ensuring that these are dealt with ethically and lawfully
5.2  Keep the library and workspaces tidy at all times, returning all books and papers to the correct place
5.3  Ensure that all matter files are tidy and organized
5.4  Manager and grow the Employee's practice (bring in new clients)

6.  Relationship Management
6.1  Assist and support other senior colleagues in handling complex matters
6.2  Understand the requirements of clients, obtain the necessary information and utilize the information for the delivery of service to the client
6.3  Establish and maintain effective relationships with the clients
6.4  Attend consultation with clients and explain relevant legal matters to them
6.5  Work with the clerk of the court for necessary procedures, where applicable
6.6  Conduct negotiations with a view to settling potentially litigious matters
6.7  Integrate best practices and standards in handling clients and their matters
6.8  Maintain good working relationships with all directors, secretaries, the receptionist and any other staff members of the Company, ensuring that the Employee is a team player in the execution of the Employee's duties
